These Terms of Service (“Terms”) govern your access to and use of FitCheck AI, including any related websites, mobile applications, and services (collectively, the “Service”) operated by FitCheck AI (“we,” “us,” or “our”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By downloading, installing, accessing, or using FitCheck AI, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service. If you are under the age of majority where you live, you may use the Service only with the consent of a parent or legal guardian who agrees to these Terms.

3. Accounts

If the Service offers accounts, saved history, or similar features, you are responsible for maintaining the confidentiality of your login credentials and for activity that occurs under your account. You agree to provide accurate information when creating or updating an account and to notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

If the version of FitCheck AI you use does not require an account, the remaining sections of these Terms still apply to your use of the Service.

4. The Service

FitCheck AI is an outfit-rating and styling-feedback app. It may allow you to upload or photograph one outfit for an AI-powered fit check, compare two outfits side by side, receive constructive feedback about color harmony, silhouette, proportions, and styling cohesion, and obtain suggestions for outfit adjustments. Features may change over time and may differ by platform, region, or subscription status.

Important: FitCheck AI evaluates visible styling choices in images you submit. It does not provide medical, health, fitness, nutrition, mental-health, legal, financial, or other professional advice. Outfit scores and suggestions are subjective styling opinions generated with automated tools and are not a substitute for your own judgment or professional stylists.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms;
• Upload content you do not have the right to use;
• Attempt to reverse engineer, scrape, overload, or disrupt the Service;
• Interfere with other users’ enjoyment of the Service;
• Misrepresent the Service’s output as professional fashion, medical, or legal advice;
• Use automated means to access the Service except as expressly permitted.

6. User-Submitted Outfit Photographs

You may submit photographs or images of outfits (“User Content”) for analysis. You retain ownership of your User Content. By submitting User Content, you grant us a limited license to process, transmit, and temporarily store that content solely as needed to provide the Service (for example, to generate styling feedback, comparisons, or shareable result cards you request).

You represent and warrant that: (a) you own the User Content or have all necessary rights and permissions to submit it; (b) your User Content does not infringe others’ rights; and (c) your User Content complies with these Terms and applicable law.

7. Photo Ownership and Permissions

Do not upload images of other people without appropriate permission where required by law or consent expectations. Do not upload images that contain confidential information you are not authorized to share. You are solely responsible for obtaining any consents needed before submitting photos.

8. AI-Generated Styling Feedback

Feedback, scores, comparisons, and suggestions are generated using automated systems that interpret visual styling cues. Results may be incomplete, inaccurate, inconsistent, or unsuitable for a particular occasion, body, culture, or personal preference. You should treat all output as informal styling guidance only.

Outfit scores are inherently subjective. Different users, occasions, and style goals may reasonably lead to different conclusions. We do not guarantee that any score, ranking between two looks, or suggestion will match professional stylist advice or your personal taste.

9. Prohibited Image Uploads

You must not upload images that:

• Contain illegal content, exploitation, or abuse of any person;
• Are sexually explicit, pornographic, or intended to harass or threaten;
• Depict minors in any inappropriate context;
• Contain malware, or are uploaded to probe, attack, or disrupt systems;
• Violate another person’s privacy, publicity, or intellectual-property rights.

We may refuse, remove, or restrict processing of User Content that appears to violate these rules.

10. Intellectual Property

The Service, including its software, design, logos, trademarks, and documentation, is owned by FitCheck AI or its licensors and is protected by intellectual-property laws. Except for the limited license to use the Service as provided, no rights are granted to you. You may not use our name or marks without prior written permission.

11. Purchases and Subscriptions

If FitCheck AI offers in-app purchases, subscriptions, or premium features, additional terms presented at purchase (including those of the Apple App Store, Google Play, or other payment providers) may apply. Prices, billing periods, and renewal terms will be disclosed at the point of purchase where applicable. Manage or cancel subscriptions through your store account settings according to that store’s policies. Refunds are handled according to the applicable store’s rules unless otherwise required by law.

If your version of the Service does not include paid features, this section applies only if and when such features become available.

12. Third-Party Services

The Service may rely on third-party infrastructure, AI providers, analytics, crash reporting, or app-store platforms. Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third-party services we do not control.

13. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT STYLING FEEDBACK WILL MEET YOUR EXPECTATIONS.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FITCHECK AI AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF THE SERVICE OR RELIANCE ON STYLING FEEDBACK. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) FIFTY U.S. DOLLARS (US $50), EXCEPT WHERE LIABILITY CANNOT BE LIMITED UNDER APPLICABLE LAW.

15. Termination

You may stop using the Service at any time. We may suspend or terminate access to the Service if you violate these Terms, if required by law, or if we discontinue the Service. Provisions that by their nature should survive (including ownership, disclaimers, and limitations of liability) will survive termination.

16. Changes to the Terms

We may update these Terms from time to time. When we do, we will revise the effective date and may provide notice in the app or on our website. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms, except where additional consent is required by law.

17. Governing Law
